Even if they did require permission from someone to reuse NJ intellectual property, it wouldn't be the girls that would be the one to grant that permission. They don't own squat.

For starters, you can commit intellectual property theft even with your own contracted employees if you don't give them proper credits or have a contract that gives you full control of their entire output for life. For example, SM contracts out for a lot of their 3D art, especially moving art. They secure licensing agreements to maintain that art but if they want to slightly modify that art while still maintaining the same design, they either have to make a new contract with the original designer or create new art that is visually distinct enough that it doesn't infringe on that artists' creative property.

 

MHJ is infamous for keeping a lot of her IP and that's part of why she and SM had a falling out. MHJ finally got to release her version of White Fox (NJZ), but you'll notice that SM's version of White Fox (H2H) had to be altered dramatically DESPITE having MHJ as a contracted employee because MHJ holds the rights to her IP.

 

Just because one creative is under another sublabel in the same company does not mean you can plagiarize at will or use their creative IP. There's a reason H2H can't just recreate NJZ's choreo and had to make their mascot a horse instead of a bunny and had to create a different sound even though their label had NJZ's IP under their label and MHJ's work was contracted to them. BELIFT cannot plagiarize ADOR just because an ADOR employee was paid for their art for a comeback, especially when BELIFT did not pay that artist.

Miss A had terrible longevity and got surpassed by NJZ in a matter of months.  I'm an Aespa stan and used to get dragged for downplaying NJZ, but damn, y'all take delusion to the next level. Miss A had two smashes, two big hits and a bunch of mild successes. 
 

NJZ are #1 all-time for female groups for digital points (about to be the first to hit 10B). They have over a decade of weeks on the chart and they've been around for a bit more than 3 years :deadbanana:  They have a chart run that would have cleared all of our faves digitally.

Releasing two title tracks, one in English and one that dropped w an English version, that both include remixes from Western artists is not seeking Western Validation? Im extremely disappointed in the downward trajectory in their artistry but I still want them to succeed at the end of the day. Theyre the textbook definition of underperformances. The main response was to Zack because he called both 'huge' hits, when they aren't. I'm glad you actually backed up an argument with real stats though because you definitely put things into a clearer perspective on how theyre performing above the other peer groups even when its not to their standard. 

Okay, but if tertiary videos are the reason the songs have more streams on YTM, then they're also the reason the music videos have less streams on YouTube.

 

I don't see including an English version or featuring a Z-list artist as a feature as an attempt at securing success here because it doesn't have any effect whatsoever. SM didn't put them on playlists (the most effective method), had no promo stages for "Dirty Work" and 2 khia stages for "Rich Man" (two weeks after release) and didn't even bother reporting physical single sales to Billboard. There's always this narrative that SM is obsessed with Western validation, but it just isn't true.

 

Also, sorry - I don't recognize anyone here anymore except Pluto, Sheep and Oprah just because Avis don't load (which is why I have such a shitty avi still). I think you were both right to some extent - Rich Man and Dirty Work are huge drops in success from Whiplash, but for being title tracks #10 and #11 in their fourth year, they are a massive success. Aespa are already at "hag" status in South Korea and at a point where girl groups usually drop off in success. Personally, I'm glad "Dirty Work" and "Rich Man" were a big drop in success but fans like you have been vocal about not enjoying the music, so hopefully it means we'll see more Whiplash/Drama/Supernova-esque title tracks soon. I have a feeling they're saving something good for ae2.

I yearn for them to go back to Kwangya days. Their songs feel very safe compared to their initial output nowadays. A 5 track EP of semi futuristic hits (or something at least on par with the excellent My World) would suffice. I just miss the throwback to pop of yesteryear they were giving us. They felt like a cousin of 2ne1.

These fees only apply if the group continues with promotional activities while still under their contract, which they haven't done. The only fees they'll likely pay are the court fees, which are capped in most cases (though the exact amount would depend on the case, but it's not going to be anywhere near that amount). 

 

It's obvious they'll just keep appealing in hopes they can run out the contract time and then move on to another agency, assuming they continue in entertainment. Sucks for us and them, but it's better than going back to a toxic workplace.
