People are forgetting that HYBE's plan was always to shelve NewJeans - even before the members tried to terminate their contracts and wanted to leave the company. After HYBE kicked Min Hee-jin out, they made this statement about NewJeans going on hiatus for a while because they were supposedly looking for "Grammy award-winning producers" to make music for them, etc.. 

 

NewJeans had every right to at least try to get out of their contract with Ador/HYBE who openly tried to sabotage them.

The girls always knew that HYBE wanted to sabotage them and are 100 % right in their case.

 

 

 

Even if true yeah it sucks but its not something u can go to the court for.... The company can do whatever they want to their products... Did AS sued? or any other group thats on hiatus? NO cause they cant

not defending Hybe, just being realistic. Anyone with a bit of objectivity can see that they got some poor legal advice to go scorched earth against their contract and it didn't pan out. It woulda been nice if everybody got their way and got along and got what they wanted, but this is business, basic contract law, and big money is involved. It didn't work out, so now it's time for both parties to start seriously working towards some sort of mutual agreement that allows the contract to be seen through to completion.

The company has invested millions in this group, it's not your typical 9-to-5 job where you simply collect a paycheck each month. Even in regular office roles, employees are required to give a two-month notice before leaving, and many companies go as far as having non-compete clauses to protect their interests.

well, I mean, sure, but unfortunately that's not how contract law works. Absent any reasons to invalidate the contract (which several courts of law have determined are not present in this case), they can either buy themselves out of the contract, or hold up their end of the contract. That's the whole point of a contract.

 

they can leave their job, but only if they fulfill whatever the early termination agreement would be. If they wanted to make it so someone can just unilaterally say "contract is over, I don't wanna do it anymore", they would have to get new legislation passed which would basically make all valid employment contracts able to be cancelled at-will, which is a huge ask.

Even if they did require permission from someone to reuse NJ intellectual property, it wouldn't be the girls that would be the one to grant that permission. They don't own squat.

No one is saying internal theft technically warrants IP infringement but intellectual misappropriation is a huge ethical violation. MHJ had solid grounds for retaliation for how HYBE responded to her internal complaint. All of this is not magically independent of a hostile work environment which is tied to breach of trust. Too bad Korean court needs to protect the corporations.

I mean they're not regulars workers, they're not just being paid to do a job at regular hours, they share profits of the things they make. If anyone could leave contracts anytime they would that would send dangerous precedents. Imagine for exemple you sign a contract hiring a team to build a house for you and suddenly halfway through they're like "hm actually we don't want that anymore". I think a more grounded discussion would be for contracts to be shorter, since 7 years is a long time to work somewhere you don't want to and it's not like that hasn't been done before. Kpop contracts used to be 10 years and now it's 7.
