NY Law is very ****** up that they consider it a "valid consent" when someone gives it while being under the influence - the way it's structured seems to favor the perpetrator in almost most cases. Because in contrast with laws of other places, when some gives a consent while intoxicated, that constitutes "vitiated consent" - which deems their agreement as defective from the start, thus it's no longer a consensual sex but a criminal offense (rape). One cannot possible give a consent "with a clear conscious mind" while being intoxicated / drugged. And based on the situation Jane Doe described (her original 2024 statement, she seems influenced to take drugs too as she was alone and drunk with the other boys (yes, she consented, but a vitiated one).
