Honestly, this whole trademark issue was really an amateur work. I mean, why the hell her team only filed for those last year? And how the hell didn’t they see that the old one was expiring? She was vocal about the re-recordings in 2019 and they only started doing things in Jan 2020. I swear to God!

more like singer/songwriter kind of music

 

 

For God's sake, I wish she delivers this kind of music too because I enjoy this kind of music

but, Taylor has never showed her pallette/admiration to this kind of disco sound, even in her most diverse Pop album (Lover)

I just don't want any other pop albums from her. What makes her stand out as an artist are songwriting and storytelling. 1989 was good because she did everything she could to get perfect production. Reputation and Lover showed her limits and that pop is NOT the genre that makes her shine as an artist. Her greatest strength are her lyrics, and I don't want her to tone that down ever again in order to fit the pop music mold. This is why I hope for any genre that she'll want to play with for the next album, as long as that genre allows her to bring her A-game in terms of lyrics/songwriting. I'm sorry but I don't want a 1989/Reputation/Lover after she displayed incredible artistry with folklore/evermore. Was she more successful when released pure pop music? Yes. But was she releasing incredible album quality wise? No. They were just good/great, but nothing outstanding.

I think she can play a back and forth between Pop/an era which conveyed her songwriting more

 

or she will come back later to make a Pop comeback, like Beyonce with Renaissance

Let's be real, she need bangers to do a stadium tour

I 100% agree. She’s going to come with stadium bangers for her upcoming (few?) releases. When she next decides to take an extended break (like she decides to get married or have a kid or just step away for whatever) I think she will serve an acoustic artsy album like the folkmore sisters which she records out of her house again. 
 

That doesn’t mean I think TS10 won’t be some new genre like rock. It just means I think whatever genre the lead single/album is, she wants it to be another mass market appealing hit.

Right. When this was previously brought up, I wrote an elaborate response with supporting links and the works, but as it turned out, I spent so long collecting the info and typing that the forum logged me out. And, to rub it in, then 503-ed twice when I attempted to touch up the recovered part and post it. This will be a briefer and less substantiated version of that post, but:

 

twitter user Hannah seems to be imply that the OnePlus Class (0)35 Speak Now trademark will block some or all publicity Taylor/Republic/UMG may attempt for the re-released album. She seems to be under the impression that only one trademark per class can exist and/or that the holder of a [registered - ®] trademark in a certain class can block anyone from commercial activities that fall under the class description for which the trademark has been registered. Both are emphatically untrue. In my erased post I had linked just a couple examples from the more than 24 thousand registered trademarks containing the word Red on file at the USPTO - both of them combined marks where the verbal component was just 'Red'; both in class 35; both predating the release of Red TV. But since they are held by clothing companies for different types of clothing, they obviously did not prevent or delay the release of the rerecording. An even more pertinent case is the... actual Speak Now (2011) trademark, which, as you can see for yourselves if you follow the link, is alive and well and owned by Taylor for Class 35.

 

I gather that some people believe that that original trademark had lapsed, perhaps because Taylor's team had missed the deadline to renew it, and that OnePlus pounced as soon as Taylor's trademark had been expunged. This is not true: as you can see from the reminder letter the USPTO sent to her lawyers, while the regular renewal was only available until December 27, 2021, they had a grace period of another 6 months (June 27, 2022) to renew against a higher fee. Only if they had missed that deadline, the trademark would have been canceled and unavailable for renewal. If you click the Documents tab on the earlier link, you can see the relevant documents for renewal were received by the USPTO on May 25, 2022, and, since no objection has been noted, the renewal should proceed automatically. It follows then that OnePlus filed their application for a class 35 Speak Now registered trademark to coexist with Taylor's Speak Now trademark - which was granted by the USPTO, as their examiner at the time apparently did not find any potential for confusion between the two trademarks. Now, arguably, Taylor's team's mistake was that they did not object to that application, but I would like to note that (again, contrary to what Hannah seems to suggest) the opposition to Speak Now (Taylor's Version) ® was not raised by OnePlus, but by the USPTO examiner for Taylor's application, who for some unfathomable reason felt that Speak Now (Taylor's Version) ® has more potential for confusion than the two Speak Now-s. The USPTO examiner must have been an Arianator.

 

Even if the OnePlus class 35 registration is considered to have precedence, this does not mean that the advertising for the rerecorded album needs to be cut. A simplistic and somewhat facetious example is that Microsoft cannot block glaziers from advertising Windows, despite having all possible sorts of trademark protections for that word and a very competent and litigious legal team. The legal problems begin when there is a reasonable potential for confusion between the two products offered to the market, which in this case I simply do not see.  What it could mean, however, is that a counterfeit merch producer could make an argument that their goods are celebrating OnePlus achievements in voice recognition software and this might be a huge issue for Taylor's team.

 

Of course, usual disclaimers apply: I am not a US attorney; I only do incidental work in IP; most importantly: CYA an abundance of caution is a cardinal rule for all lawyers, I cannot exclude the possibility that Taylor's legal advisers indeed want to postpone the Speak Now (TV) release until the case has been definitively resolved. The last part also applies to another statement which made me raise my eyebrows: that UMG are blocking the 1989 (TV) release until the Shake It Off case has been laughed out of court come to a conclusion.
