The 'New Jeans situation' is heading towards a head-on collision as Adore, the agency of girl group New Jeans, has filed a lawsuit for 43.1 billion won against member Daniel and former CEO Min Hee-jin.

According to legal sources on the 30th, Adore filed a lawsuit against Daniel, his family, and former CEO Min Hee-jin, seeking approximately 43.09 billion won in damages. The case has already been assigned to the 31st Civil Division of the Seoul Central District Court, which is currently hearing a stock dispute between Hive and former CEO Min.

However, skepticism prevails as to whether the court will fully acknowledge this astronomical claim. Legal experts believe the likelihood of the court granting Adore's full 43.1 billion won claim is extremely low, less than 5%.

"43.1 billion won is excessive"... It's difficult to avoid the court's "cutting the penalty."

Even if the court rules in favor of Adore, the claim is likely to be significantly reduced due to a principle stipulated in our Civil Code. Article 398, Paragraph 2 of the Civil Code stipulates, "If the estimated amount of damages is unduly excessive, the court may reduce it appropriately."

Legal experts analyzed that the amount of 43.1 billion won is excessively large compared to typical exclusive contract dispute cases, considering Daniel's remaining contract period and New Jeans' projected sales.

In particular, looking at past case law, the court strictly considers the actual extent of damages incurred rather than the agency's expected damages, and even if there is a penalty clause, it is often reduced to around 60-70%.

Has the investment already been recovered? Daniel's "talent contribution" is a variable.

Adore's side is expected to argue for the investment costs (education, production, marketing, etc.) poured into the debut and the loss of profits due to Daniel's departure (future earnings that would have been earned had the contract been maintained). However, the court is likely to apply two brakes here.

First, Daniel's contribution. If the court determines that New Jeans' success stems not only from the agency's planning prowess but also from Daniel's individual talent and popularity, the court will deduct the artist's contribution from the total damages.

Second, the costs have already been recovered. Since New Jeans has already achieved global success and generated significant sales, Adore can assume it has recovered a significant portion of its initial investment, thus lowering its actual losses.

Proving the joint illegal act against Min Hee-jin and her family is the biggest challenge.

Adore is holding former President Min and Daniel's family jointly liable for the tort, claiming they instigated or assisted in the breach of contract.

However, this is a very difficult area to prove. Clear evidence is needed that former CEO Min directly ordered Daniel to terminate his exclusive contract, and it's difficult to view family advice or support as illegal interference. If there's insufficient evidence in this regard, any claims for damages against former CEO Min or his family will likely be dismissed.

Legal circles predict that the amount of compensation that the court will award in the final ruling will be between 1 billion and 5 billion won, which is approximately 2% to 11% of the claimed amount.

I was confused why it wasn't 430 billion won. That's closer to the "value" Ador has lost since the shaman gaslighted Heejin and it would just add another layer of ridiculousness to this clown show.
