In a development that will have major impact on Kesha's upcoming appeals at New York's highest court, New York's Chief Judge Janet DiFiore has announced that she is retiring by the end of August, three years before her term ends.

 

New York's highest court, the Court of Appeals, consists of seven judges. Six of those judges have been nominated by former Governor Cuomo, one by incumbent Governor Kathy Hochul. Governor Cuomo was notorious for nominating conservative judges to the Court of Appeals, the most notable being said Chief Judge Janet DiFiore (a former Republican and prosecutor from Westchester).

 

Last year, this trend reached its peak when two vacancies were filled with judges that created a rigid 4-judge conservative bloc spearheaded by Chief Judge DiFiore that formed the majority in most of the court's recent cases. The other members of this conservative bloc are close allies of Chief Judge DiFiore.

 

Her early retirement shakes up the entire ideological composition of the court and could be the decisive factor that Kesha needs to win her pending appeals at the Court of Appeals, given that the Chief Judge wields extraordinary power in shaping the court's opinion and an ideologically different Chief Judge could destroy this narrow conservative majority at the court.

 

There is high pressure on Governor Hochul to nominate a significantly more liberal Chief Judge since the court's recent conservative trend has drawn much criticism from policymakers and experts alike. Specifically, many policymakers are disappointed with two of the court's recent appointments that turned out to completely vote in lockstep with Chief Judge DiFiore and there is high demand for the Court of Appeals to become a bulwark against the even more conservative inclinations of the US Supreme Court. Additionally, many New York Democrats are angry at Chief Judge DiFiore because her conservative 4-judge majority recently declared New York's congressional maps void because of extreme gerrymandering from New York Democrats, increasing the likelihood of an ideologically different Chief Judge.

 

 

As you may recall, Kesha has two pending appeals at the Court of Appeals: her first one from 2021 regarding whether Dr. Luke is a public figure and whether her allegations outlined in official court documents are non-actionable for defamation thanks to litigation privileges, and her second from two weeks ago regarding whether New York's amended anti-SLAPP statute is retroactive or not.

 

Since the court will probably decide both of Kesha's appeals together, after the briefing of her second recent appeal is completed - which most likely will not be before November this year or 2023 - Chief Judge DiFiore's retirement directly affects the outcome of Kesha's appeals.

 

It is not clear whether there will be a new Chief Judge by the time Kesha's appeals will be heard, but I think it's safe to say that this is a huge win for her either way.

 

If there is a new Chief Judge by the time Kesha's appeals will be argued, the odds are very high that whoever that person is will be much more liberal than Chief Judge DiFiore. If there is no new Chief Judge by the time Kesha's appeals get argued, then that increases the potential for a 3 : 3 tie at the court (which happens quite often if one of the judges is recused) and in that case, appeals get reargued at a later date...which would most likely be at the time a new Chief Judge is in office.
