All the think-pieces about the NewJeans situation are interesting to read but I feel like everyone is overestimating the actual group members' agency in this debacle. From my perspective it seems like a bunch of kids were emotionally manipulated by the adults employing them on either side of a power struggle. I'm sure there's stuff we'll never know about and the actual truth of who did what will probably never be clear but the mere fact that the group members took such an insane stance (no legal basis for their actions, no evidence, etc.) says, in my opinion, that they were completely isolated from anyone who would give them actual good advice or, like, was in touch with reality at all. Like they were children at the time that this was all happening and very clearly nobody involved had their best interests at heart. It's really, really depressing.

 

A bunch of kids entering the entertainment industry and becoming so reliant on and emotionally attached to their boss that they're incentivized to go scorched-earth against their employer on the basis of pretty much nothing.......there is a word for that. :emofish:

When we look at the several case (most famous ones being 50/50 & NWJNS) all we see is most of the members are underages or very young adults.

Interesting think-piece about Newjeans situation but I feel like you are overestimating your knowledge of the members and the situation in this debacle. From my perspective, you seem like a kid who was emotionally manipulated by the media. We actually know what the truth is, but you would have to take the time to read up on the situation, or at the bare minimum watch the 2-3 videos where the concerned parties voice their complaints publicly. In my opinion, you seem completely isolated from actual news sources and proper translations, and like, not in touch with reality at all. Like you are a child when this is happening and very clearly nobody had your best education at heart. It's really, really depressing.

This whole new jeans situation is so unfortunate, they are only kids in the end, and yes we shlould blame the adults (hybe and mhj) i just dont understand to this point that there are still people who defend mhj or hybe like they are booth greedy af. Just because i hate mhj doesnt meant i side with hybe. I just just dont understand why people force words in others mouth that if you support NJ then we should support MHJ too...this idea of them is belong to each other is what honestly feeding the girls ego.. the reality is that they are only workers signed to hybe...i think what MHJ did to them really screwed their ego and mental like they are willing to publicly lying in court :deadbanana4:...and now they are getting hate here and there....this is so unforttunate becuse they are only minors.... Not sure if she's evil or if she's just really open to evil possession.  Regardless, even though this has been a fairly obvious case (Korea just makes it more so) there is this tiny part that will forever wonder if she wasn't set up. 

 

The idea Bighybe would give an outsider what in a really short time became estimated at $100 million just to ride BTS' coattails is one of those things where someone the next morning would think back at what ridiculousness they had agreed to and would immediately start to figure out ways to get that fumbled piece back before it started to go multiple.

Like legit Itzy's downfall should be studied. I disliked them on their debut but even I couldn't deny they were MASSIVE and I had no choice but to seethe.

 

Giving most lines to Chaeryeong is a choice tho, her voice is just bland. Welp.

As someone who DID read the full rulings, and everything related to it or leading to it, both in Korean and English, and is a bit familiar with Korean online culture, Korean media landscape and Korean law :

 

Was Newjeans bullied and discriminated against by Hybe? Yes, like basically all idols to a varied degree. Then why did they lose in 1st trial?

 

1. The bar to terminate your idol contract from bullying alone is very high - (most contracts terminated for financial reasons)

-> Idols are NOT workers -> no legal protection -> no government investigation -> lack of evidence

-> HYBE deleted some hard evidence (CCTV) -> lack of evidence x2

-> HYBE's multi labels system is a legal shield  -> bullying from parents company / sublabels not an issue (different from SM, YG or JYP) -> very confusing for the judge

-> HYBE's law firm Kim&Chang is the legal mafia of South Korea. It's a revolving door for ex judges, ex prosecutors and ex politicians with ties everywhere -> good defense if you spend $$$

 

2. What about breakdown of trust - That's Newjeans' main argument btw, not the bullying.

-> lack of precedents -> It's a constitutional notion that falls under Human Rights that needs to be appealed all the way to the Supreme Court for review (the judge only wrote 2 pages about it in the 1st trial, and 0 in the injunction)

-> MHJ's shareholder case ruling delayed -> That's the crux of the Newjeans lawsuit that sets the facts straight - was MHJ unjustly fired or not? -> No ruling = no fact = no defense.

 

Could Newjeans overturn the 1st trial ruling? Yes.

 

-> MHJ winning her shareholder case would flip the narrative from -HYBE is right- to -MHJ is right- giving Newjeans better odds.

-> Breakdown of trust -> higher courts are better qualified to do in depth legal reviews of the law

 

And if not? They tried.
