The copyright is already hers and the other is not being asked to be used for Entertainment purposes. 

There isn’t a lawsuit for Speak Now. She wanted to buy the trademark name in February and the company said no so they still currently own it. The copyright isn’t hers anymore, it expired and OnePlus snatched it up. I’m not trying to be condescending but google is your friend. It doesn’t matter that the other company isn’t using speak now for entertainment purposes they own the title and she can’t release an album in 2022 called Speak Now because the name is already taken

So right now there’s a lawsuit with some company because Speak Now (TV) is already a registered trademark and Taylor offered to buy the name and they said no because their product is already associated with Speak Now TV and they aren’t willing to give it up, so unless Taylor changes the name of Speak Now she absolutely cannot release anything ‘tv’ related (album or merch)

 

One of the shake it off lawsuits was dismissed but there’s still one going on that keeps getting delayed (I think it’s not going to be done in court now until October) and Taylor can’t release shake it off OR change the lyrics because that would basically be her admitting that the lawsuit is legit. If she would release a re-recording of 1989 and then go on stand and lose the trial, she would end up having to pay significantly more money. The problem with the copyright trial is she’s claiming the phrase is a common phrase, while also trying to trademark it, so it does seem a little greedy on her part (please don’t come for me swifites I love her but that’s how a jury is also going to see it)

The Speak Now trademark issue has nothing to do with the fan abbreviation “TV.” It’s just the phrase “Speak Now” that the trademark fight is over; the US Patent & Trademark office is of the opinion that “Speak Now (Taylor’s Version)” is close enough to a breach of OnePlus’ “Speak Now” voice activation service (which simply happens to be included on televisions) to have rejected her initial application. If it was a serious enough matter to stop her from releasing the album at all, I would think it should have been serious enough to prevent her from releasing Speak Now merchandise recently, but she did that anyway.

 

Similarly, if the Shake It Off lawsuit was enough to prevent the release of a new version of the song, we would either see court documents stating as much or we might expect the original version of the song would be pulled from streaming services.

 

We really don’t have enough information to understand whether the apparent lack of updates has something to do with these legal situations.

she's allowed to release the album lol. she just isn't allowed to do promo/ads/banners that say "Speak Now"

The lawsuit for shake it off hasn’t even started yet, that’s why there’s no documents for it. The one was dismissed and the other wasn’t and keeps getting delayed. If she would remove the original shake it off from streaming that would be here admitting she’s at fault so that would be the worst thing she could do. This lawsuit has been going on since 2017, it’s not a new thing. 
 

Releasing speak now merch on her website isn’t as big of a deal as releasing a whole new album and Speak Now (tv) merch

that’s why I said she can’t release an album called speak now in 2022. Not she can’t release it at all. There’s no way she’s going to release a whole album and have absolutely no promo or anything. She should just call the album Enchanted (Taylor’s Version) since that’s what she wanted to name the album originally and be done with it

At this point it’d be best for her to just be transparent and open about what’s going on. Or tell all these popular accounts to stop using her name for clout. It should be obvious that 1989 and Speak Now can’t come out right now due to her multiple legal/name issues, but this whole thread is proving otherwise
