Legally this is not going anywhere because that ingredient is approved by the FDA, however I know since awhile there is a movement and several associations also here in Europe that have started doing this because they want that ingriedient banned since it has been proved to not being healthy especially if ingested, I know several food brands had to took it away from food here in Europe, (M&M's notoriously are considered bad for that ingredient), whereas for pills is still legal to use. I know it's better to avoid it for food-pills for sure, I don't know when it comes to comestic stuff since make up gets removed and not ingested but yeah it's also heavily used in majority of suncreens. However this might just push the brand to reformulate and substitute the ingredient so it's not necessarly a bad thing or a big deal in negative.

It technically isn't Sephora's fault (or rather, they wouldn't be liable in a lawsuit in this case). In regards to this law, it's the responsibility of the manufacturer to put a Prop. 65 warning on any product that may "cause cancer, birth defects, or harm reproductive health." The law has good intentions but is kind of overkill, so just about every cosmetic, multi-ingredient packaged food item, or household product that is sold in the United States has some small text on it bringing up Prop. 65 that says "ingredients in this product may put certain people at risk, blah, blah, blah." Most people ignore them tbh. But as stupid as the law is, it's one of the most well-known laws in manufacturing (in the US). So I'm shocked that Haus Labs wasn't sticking a Prop. 65 warning on all their products, because it would've prevented this lawsuit and most customers ignore them anyway. Though if it makes any difference, I think these lawsuit usually just end with the defendant coughing up some money, labeling their product(s) in accordance with Prop. 65 and then moving on. Titanium dioxide is not carcinogenic in the correct formulation which is ALL cosmetic products. It is potentially toxic if the RAW titanium dioxide DUST is frequently inhaled which can happen only in mining or manufacturing. It is also used in mineral sunscreen along with zinc oxide. This lawsuit is a cashgrab joke that's not going anywhere. 1 1
