Just a Gay on ATRL Posted September 11, 2023 Posted September 11, 2023 The tattle tale twitter account @'ing Taylor Nation to try to get Shakira and her team sued. It's indeed inspired/copied from Eras - but I think it would be a waste of everyone's time to make this a big deal, and I don't think Taylor should get to take ownership over the concept of popstars compiling a bunch of their looks together onto one shirt for a design - this is one of those times Taylor & her team need to apply the "choose your battles" mentality. They can maybe talk to Shakira's team & get her to cancel & change the merch design if it bothers them. But Taylor suing Shakira would NOT be a good look for her. When something is as popular & trendy as The Eras Tour, it is inevitable other things will be inspired by it. I don't think similar tour merch is the end of the world. It won't stop Eras tour from selling anything. 1

Again, the design itself may not be unique or innovative in your eyes, but at the end of the day plagiarism is plagiarism and Shakira’s team has plagiarized the exact design conditions that make up this merchandise Taylor has been putting out for years. You keep saying plagiarism but the legal term is actually trademark infringement and the implementation of a commonly used font is not legal grounds to suggest that one unique work had its trademark infringed on. Is the font being used one Taylor's team commissioned to be made by hand by a designer? If not, of course fonts will repeat themselves out in the wild. 1 1

You’re right this is a “choose your battle” scenario where Taylor and her team theoretically should do nothing, but from an artistic standpoint the artist who created this design shouldn’t be so blatantly ripped off by another big company that just wants to lift the exact design. Regardless of our feelings towards the singers, their labels, and their teams.. there is a creator behind this design and they shouldn’t be plagiarized just because no one is willing to fight back. It sets a bad precedent for future artists

I’m not using plagiarism in legal jargon I’m using it colloquially. If I’m in an art class and I draw a bowl of fruit with my name layered on top in times new Roman and someone else draws a bowl of fruit, just colored differently but the same font placed in the same place, when we turn those projects in the teacher would ask which of us plagiarized the other. Imo that’s no different here 3 1

glitch Posted September 11, 2023 Posted September 11, 2023 I doubt Taylor or Shakira had much involvement in the design of their merch. And most merch just follows the same basic template, with just insert artist/tour/album name and some space for a pic or two.

peacok Posted September 11, 2023 Posted September 11, 2023 I'm just mad she decided to ignore her brunette days, if you're going to copy at lest do it well
JustLikeHoney Posted September 11, 2023 Posted September 11, 2023 I don't know why people think Shakira does anything original. She as been sued for copyright over and over again. She always manages to win or blame those "around" her. She did it to the wrong girl this time. Taylor will win 70% of the profits from the merch guaranteed. 3 1 5
Venice B Posted September 11, 2023 Posted September 11, 2023 I mean yeah they look identical but it's not like Taylor's version (ha ha) was that original to begin with

vuelve88 Posted September 11, 2023 Posted September 11, 2023 Shakira's team was super dumb for copying the style of the literally the most popular artist in the world.
