chiliam Posted September 11, 2023 Posted September 11, 2023 Woa i thought the Swifties are reaching. But they actually have a case with this one. Its identical.

Not in a 180 degree horizontal line with the artist’s name in a font layered behind the imagery like the other two. Those 2 are the same. The Beyonce one isn’t the same design at all. The fact I even have to say that when you can just see that with your own two eyes is a little baffling if I’m being honest. You can say there’s similarities in the creative vision or the artwork but the designs themselves are not the same the way they are for Shakira & Taylor.. 7 minutes ago, Communion said: Sis, I'm sorry but you're just like..empirically wrong. "I don't mean legally" - then what is your point? It's nonsensical to bring up plagiarism in academia. 1) Based on what you said, you both would fail for being unoriginal. 2) Plagiarism in academia would see you fail not because you committed trademark infringement but because you're in the unique context of education and being asked to apply your ideas to a prompt to show you understand the elements of design you were taught. You'll fail for trying to cheat the assessment, not for unoriginality. You can't just trademark indistinguishable elements of design. Your comparison is like saying because you drew a circle, anyone else who draws circles in the same way is copying you. No, you have to show elements are distinct. Why do you think so many pop acts have made official merch in the style of 90s rapper tees despite them all largely similarly with the same design elements? You can't trademark an aesthetic~*. Taylor being lawsuit happy with fans seems to have confused some people. Taylor can sue fans for having merch dupes not because she owns the creative idea, but because she owns her likeness and identity. The Shakira pullover: - Uses no likeness of Taylor (duh) - Uses a different typeface (and since you didn't answer, I looked up the typeface for Taylor's and it's not a custom one she commissioned) - Uses illustrations in a different art style Now, is it unoriginal? Sure. But the idea is so simple and bare in its design that we see its very easy to be similar (see Taylor inadvertently copying elements from the Beyonce EP cover) and it's a matter of business more-so than legalese. Will Shakira's label think their money was well spent on such an unoriginal design? Maybe. Maybe not. But being unoriginal is not a crime, and if it were, both designers of either Taylor and Shakira's shirts would be getting life in chair. *gavel bang* [Khia voice] Electric chair. I’m not really claiming that Shak+team infringed on any copyrights though. I’m really just saying that whoever greenlit this merch is blatantly ripping off the exact design that has been produced yearly from Taylor’s team and that it’s not cool. I’m not saying anyone should or shouldn’t go to court or that anyone is committing any crimes — I’m just observing that this exact design has been copied. I won’t use plagiarized if that’s not valid here but this design is *** for tat the exact same as Taylor’s. It’s not a matter of generic and similar ideas, it’s the exact same execution in design..

ATRL Moderator Oxygen Posted September 11, 2023 ATRL Moderator Posted September 11, 2023 It’s very plain and simple to observe that Sharika’s design is near identical to Taylor’s. I have no clue why people are trying to assert that 1) Taylor didn’t invent the concept of “eras” and 2) Taylor merch design isn’t wholly original, because I don’t think anyone is refuting those points. Y’all are just arguing with the wall at this point 10 3
Mystic Boy Posted September 11, 2023 Posted September 11, 2023 Does Shakira have her American Citizen card? If not, you better hurry sis, some colleague could report you and forbid your entrance

1989 Posted September 11, 2023 Posted September 11, 2023 The users in here acting utterly dense. No one’s saying Taylor or her team invented the concept of “Eras” or that particular design, obviously both concepts have been used by many pop stars now for decades. However, the design has been changed slightly each time as to avoid being a direct copy of the original/others before it…except this one. Shakira’s version of this merch pretty much directly copies Taylor’s version (for lack of a better term nnnn). It’s okay to acknowledge this guys, nothing bad will happen and you can still dislike Taylor. Imagine that! 5
TYMPS Posted September 11, 2023 Posted September 11, 2023 Shakira's has better, more iconic looks, that's for sure 1 2
kataraqueen Posted September 12, 2023 Posted September 12, 2023 It's literally a fashion illustration with a vogue font... this is why your set of references shouldn't start and end with a mainstream popstar lol 2

And Shakira didn’t even include her HDL look, she chose whatever Is Taylor labelling them as an "iconic looks collection" though?
uusagii Posted September 12, 2023 Posted September 12, 2023 Like every basic twink from 2010 with a DeviantArt account did that whole era thing for their favourite pop star
modeblock Posted September 12, 2023 Posted September 12, 2023 came in ready to drag Taylor's money hungry ways, but this is almost identical - miss shaki's criminal streak continues I see....

Illuminati Posted September 12, 2023 Posted September 12, 2023 This is very blatant but I feel like artist merch is always based on some common template that they reuse. Like I remember, I think it was Nicki who released jockstraps? And you could STILL see the Chromatica logo on her digital designs because it wasn't edited out properly 2
Gladiator Posted September 12, 2023 Posted September 12, 2023 Its funny reading through this thread and people are blind meanwhile in music threads there's always accusations of someone stealing something from another song because it uses the same chord progression or is in the same key or written by someone with a ******. 1
Solaria Posted September 12, 2023 Posted September 12, 2023 This was bound to happen sooner or later anyway, Swifties should be happy Taylor is inspiring everybody, even artists that debuted before her. Every artist should celebrate their catalogue with an Eras Tour
