Yes, you have to pay/get a license to distribute a live recording. Songwriters/ artists don't lose their rights when they sing live. Distributing a live performances violate both the performers' and songwriter's copyright. That's why live performances get taken down frequently on youtube once detected. (see how surprise performance recordings were usually taken down within 24 hours) Tiktok got an exception due to the contract with UMG which they have now lost. 1

Even if they take down all official uploads, the random fanmade sounds (sped up, slowed, nightcore, etc) will remain there, no? Like Rihanna doesn't have her catalog on TikTok but her songs still go viral thanks to those. Edited January 31 by State of Grace.

It will be Tiktok's duty to take them down elsewise they are violating Amercan copyright law which has severe penalties if taken to court. They will have to use a content id like google. 1

Arrows Posted January 31 Posted January 31 I think this was a good decision from UMG. They’re palying the long game. Tik Tok isn’t a threat as long as it makes people stream or buy music elsewhere. I don’t believe the royalty issue is the real problem here, it’s the fact that Tiktok is working to replace artists altogether. Tiktok “demanded a contractual right which would allow [AI] content to massively dilute the royalty pool for human artists” while “developing tools to enable, promote and encourage AI music creation on the platform itself,” which UMG states is “nothing short of sponsoring artist replacement by AI.” UMG is gonna lose the short term battle when pulling out, but they’re fighting for the future existence of their company and all artists. They know AI is gonna be everywhere soon, this is a step in the right direction to ensure that human-created music is still profitable 10 years from now. 4 3

Raiden Posted January 31 Posted January 31 On the surface this seems like a simple case of UMG leveraging Taylor Swift to squeeze more cash. If TikTok has a deal in place with all other major labels then it shouldn't be that hard for UMG to do the same thing. But they want more — and they have the hottest property in their roster so they are leveraging that. Let's see if they can get away with it
