The court's 6-3 conservative majority includes three justices Trump appointed. Smith's election subversion charges embody one of the four criminal cases Trump has faced. Now it's up to the lower court in DC to determine if his pressuring of Mike Pence was part of an "official act" or not, which I think they will determine wasn't. But the subjectivity of what's considered official acts going forward wasn't answered thoroughly enough, even with the examples given.
