U.S. Supreme Court tosses immunity decision; "President is now a king above the law"

The U.S. Supreme Court threw out a judicial decision rejecting Donald Trump's bid to shield himself from federal criminal charges involving his efforts to overturn his 2020 election loss in a major ruling on Monday involving the scope of presidential immunity from prosecution.

 

The court's 6-3 conservative majority includes three justices Trump appointed. Smith's election subversion charges embody one of the four criminal cases Trump has faced.

 

If Trump regains the presidency, he could try to force an end to the prosecution or potentially pardon himself for any federal crimes.

This actually makes sense, surprisingly. Now it's up to the lower court in DC to determine if his pressuring of Mike Pence was part of an "official act" or not, which I think they will determine wasn't. Trump is still screwed.

But the subjectivity of what's considered official acts going forward wasn't answered thoroughly enough, even with the examples given.

 

This kicking of the can is entirely political so appeals to Chutkan won't be resolved until well into Trump's second term, in which case all of this is irrelevant.

With three justices appointed by Trump, there is no way they would hold him accountable. The GOP is fully corrupted, from the local to the national level. 

These are really bleak times.

Trump's BFF Steve Bannon was on his show last week saying they have the Supreme Court in their pocket and he's not worried... well would you look what happened. He was on his show this morning before going to prison rejoicing over the decision.

The landmark ruling was released roughly an hour ago. Here's a recap of what has happened so far:

 

The justices ruled 6-3 that Trump has immunity from prosecution for official acts that are part of his core consitutional duties as president, and that he has zero immunity for unofficial acts

 

They have sent the special counsel's case back to lower courts to decide what is official and unofficial, but they have also given guidance on the case

 

The three liberal justices dissented, with Justice Sonia Sotomayor writing that under this decision "the President is now a king above the law"

 

Trump sees this as a major victory. So do most court-watchers

All the guard rails that held Trump back last term are all gone now.
