Like I already anticipated, in the event Kesha is permitted to assert her anti-SLAPP counterclaim, Dr. Luke wants to renew his motion (1) to bifurcate the trial and (2) quash any of Kesha's discovery requests related to her counterclaim.

 

Some will remember that Dr. Luke filed a motion to bifurcate the trial shortly after Kesha was allowed to assert her anti-SLAPP counterclaim back in 2021 so that Dr. Luke's defamation claims would be tried first and Kesha's counterclaim an unknown period of time later (and only in case he lost his claims). In the same vein, Kesha tried to her use her then-new counterclaim as a means to take discovery into Dr. Luke's PR strategy to brand her as a liar which had already been denied back in 2017 on the grounds that Kesha had no active claims against Luke at that time.

 

If Kesha wins her appeals at New York's highest court, these issues would be back on the table, and the interesting part is the timing. Dr. Luke maintains that motions with respect these issues may lead to yet another adjournment of the jury trial, while Kesha insists there can be no more adjournments of the jury trial no matter what and that the court must promptly decide the above issues either at the third pre-trial conference this month or shortly after.

Third, it has been revealed that Kesha is trying to take discovery into Dr. Luke's post-2018 income and finances. This information has not been available to her yet because discovery closed in 2018, but it seems like she wants this to be a part of the trial.

Fourth, there is a pages-long argument as to whether Kesha should be allowed to use the deposition transcripts from David Sonenberg and Georgina McAvenna from the DAS case at trial in case they will not testify as trial witnesses.

 

This likely won't be an issue given that both most likely will testify at trial, but the interesting part is that Kesha writes in a footnote that she has served an official trial subpoena on David Sonenberg this week.

Also is it common knowledge that she only likes 8/16 tracks on Warrior?

 

I assumed that it was close to this ratio and which songs she disliked, but it is interesting having this information

on K:MCBL she and Pebe were on a hike and were talking about the songs on Warrior and Kesha listed her favourites

i cant remember which ones she listed aside from Supernatural, i assume thats where people get that ratio from

we know she hated how Die Young turned out cos iirc the chorus was not written by her as Luke had someone else re-write it and forced her to sing that version.

and i personally would assume she doesnt really like Crazy Kids or Thinking of You for some reason idk

Nah theres some tweets from 2022 from someone (i assume someone in kesha’s circle) which went through all the tracks and detailed which ones she liked. Seemed pretty legit.

 

She hates Die Young and Crazy Kids specifically.

Watching old Kesha interviews made me want to cry, she's really going through all this trauma at the hands of one of the most powerful names in music since she was a teenager and this situation has changed her so much to the point where she has to carefully watch every word that she says now whereas she was so free and quick to speak.. i'm so sick at how he had the power to take everything from her and how barely anyone stood up with her against Dr. Luke. I barely learned Luke stopped payments for all the writers of Timber until Pebe agreed to be removed as a cowriter.. kesha and her family rlly needs to be commended for what she's endured its so sad and a tragedy

theyre the same account that tweeted that Kesha has continuously been wanting to release Machine Gun Love since 2012 but has been waiting for the right time to do so cos of the political climate right now around guns :bird:

Nate Ruess is not just 'someone else'.. he was the lead singer of the famous band Fun.he co-wrote die young, the chorus part, we can hear him singing in the chorus (he is in the backing vocals).many artists in the music industry hate their own music..for example Katy Perry hates 'dark horse' and she was forced to release it as a single after the huge success of the song despite that it wasn't an official single yet. Selena Gomez regretted singing 'come & get it'..Avril Lavigne hates 'girlfriend'..

When do we find out if Kesha wins her appeals? Also I was briefly reading a post above mentioning Kesha subpoenaed David Sonenberg.. would he substantially help her casefor the better?
