Can someone please explain it? Sorry, I am not from the US, but does that mean crossing the border illegally will be cracked down harder?

Background: Congress had a bill that was meant to give aid to Ukraine (that also saw aid to Israel added.. for some reason). Republicans, seizing the moment and small margins in Congress, held up military and financial aid to Ukraine to get concessions from Democrats on immigration. This resulted in Republicans writing what immigration law experts have called the most conservative immigration bill in 30 years if passed. A bill that Democrats were willing to sign into law for Ukraine aid aka why people call it "bipartisan". A bill Harris is promising to sign.

 

Context: In the bill was language that 1) the border should both "shut down" (this isn't possible) if encounters reach a specific daily number when averaged for the week and this would halt even processing all* asylum claims and 2) that the process for asylum should be modified to make it so someone who doesn't come into the country through a legal port of entry should be completely barred from filing for asylum and the system made harder to legally seek asylum.

 

Because Republicans ended up with cold feet over Ukraine, the Ukraine aid + conservative immigration law "bipartisan" bill was not passed.

 

Biden months later would issue executive orders to use his own powers over the border to implement some of the policies Republican legislators had proposed, including:

  • Implementing a 2,500 encounters a day cap to "shut down" processing at the border if reached;
  • More conservatively redefining and restricting what counts as a legal port of entry;
  • Lowering the time ICE has to wait in order to deport someone attempting an asylum claim;
  • Eliminating much of the regulations on the legal avenues the US government must provide to someone attempting an asylum claim;
  • Increasing the standard for "fear of prosecution" claims by asylum seekers to be more conservative;

 

*- The move to make these restrictions permanent would also now no longer exclude undocumented children from the encounter tally or asylum restrictions.
