Haven't read the Disney+ T&C but it probably says all future contractual or extracontractual disagreements with the company have to be disputed under arbitration.

 

It's Disney so of course all of its sub entities are ironclad tied together to speed up any litigation, also directing their cases to arbitration first helps them keep a lot of crap under wraps, and not in a public civil dispute in court. They'll probably settle with the payment and Disney forcing an NDA (as one would expect).

That makes a lot of sense. Thanks!! I still think the guy should go for more than $50,000. His wife is only worth an average American annual salary? I know you can't really put a dollar tag on a human life but $50,000 is really sad especially when you're suing Disney. That's like pennies to them.

Speaking as a lawyer, it's actually REALLY unfortunate how little is compensated to people who lost a loved one :doc: even losing a limb or an inability (even if small) get more, as tragic as it sounds, cause yeah those are stuff that can be quantified objectively, someone dying can't :doc:

This is absolutely disgusting, and the fact that he's only asking for 50K especially with Disney being ridiculously overpriced is upsetting. 

 

If the love of my life died because of an allergen that was supposed to be avoided and a dish that was specifically said to be allergen free I'd be asking for MILLIONS.
 

I'm a server and as servers, bartenders, and/or cooks you know you DON'T **** with people's allergies.

Apparently Disney doesn't even own the restaurant...

 

On Thursday, in a statement sent to the Guardian, a Disney spokesperson defended the company's legal strategy and said:

"We are deeply saddened by the family's loss and understand their grief. Given that this restaurant is neither owned nor operated by Disney, we are merely defending ourselves against the plaintiff's attorney's attempt to include us in their lawsuit against the restaurant."

The way they could have just said that instead of being like "Well you can't sue us for your wife's wrongful death because you have a Disney+ account. Hope this helps!"
