Man cannot sue over death of his wife because of Disney+ free trial, Disney says

Disney World is arguing a man cannot sue it over the death of his wife because of terms he signed up to in a free trial of Disney+.

Jeffrey Piccolo filed a wrongful death lawsuit against Disney after his wife died in 2023 from a severe allergic reaction after eating at a restaurant at the theme park.

However, Disney argues its terms of use, which Mr Piccolo agreed to when creating his Disney account in 2019, means they have to settle out of court.

The entertainment company argues it cannot be taken to court because, in its terms of use, it says users agree to settle any disputes with the company via arbitration.

It says Mr Piccolo agreed to these terms of use when he signed up to a one month free trial of its streaming service, Disney+, in 2019.

This is so dystopian. :hoetenks:

It's giving that unhinged South Park episode where Kyle is kidnapped by Apple and turned into a human centi-pad after agreeing to Apple's terms & conditions without reading it.

Lmao even if he legally bound to that, which I doubt, why would Disney not want to just take a loss after they seemingly killed his wife… He's literally only asking for 50K. This is so evil.

50k is Pennies to them, especially considering they are a billion dollar company. He is asking for such a low amount then what he deserves and it's crazy they are trying to fight it.

For one month in 2019? How are these terms still up to date then... :deadbanana:

if you read the article you'd see this very next line that OP withheld from the thread

"Disney adds that Mr Piccolo accepted these terms again when using his Disney account to buy tickets for the theme park in 2023."

furthermore

"

ibreel Tramboo, barrister at Church Court Chambers, says the terms in the Disney+ trial are a "weak argument for Disney to rely on".

However, he says, the clause in the ticket purchase from 2023 may be a stronger case, "as there is a similar arbitration clause".

"That may permit Disney to stay the case for arbitration," he says, "although there are many other threads that may prevent them going to arbitration given the delicate circumstances in this case.""

When arbitration fails, you go to court. It's not a complete dismissal.

All corporations would do this kind of stuff if they could get away with it btw. Let's stop missing the forest for the trees!

Disney being greedy and cheap, now the whole world is gonna know about this since it's gonna be on the news. They honestly should've just paid the 50k :skull:

5 bucks says he gets a settlement now that this out in public. Disney can't dodge the bad rep even when they're winning :fan:

I'm so confused. How is one like the other? One is a restaurant and one is a Disney+ streaming subscription. The wife died at the restaurant, not in front of the TV.

He is suing them for only $50k, it's literal pennies for them. He should milk them as much as he can.

I am thankful for EU cause they would never let this **** fly and would clock Disney within seconds.
