This is a silly statement. Clearly the “loophole” was that she and her distributor didn’t “dictate” anything and made it a voluntary opt-in promotional tactic, or some technicality along those lines. A film distributor is going to know laws and industry regulations and obviously isn’t just going to break them.

Not a good look honestly... since the tour production costs are already recouped by the box office, as well as any camera/filming budget. I wonder what's the theaters' cut... but they are the ones who are the happiest (just like with National Cinema Day) cause on top of any cut of the ticket's cost they will sell a ton at the concessions. I also wonder if all the swifties singing (screaming) will affect any other showtime, like noise wise.
