Smart. What is the guarantee that more Democrats would be selected upon its expansion? Or what happens in the future when it allows more Republicans in instead of Democrats?

Thing is, they have such an overwhelming and permanent majority (due to the fact that they strategically retire while liberals stupidly do not) that they really don't need to.

Anyway, I like his idea. A much better solution than expanding and risking the possibility of having more conservative judges appointed.

Maybe we should politicize it. Make it so political that it stops being relevant, or that it becomes an institution no one respects. It is clear these judges are not ruling with impartiality, so why try to preserve the institution? They are able to swat down constitutional protections or even laws a co-equal branch of government passes, so why keep it around? It is supposed to be an equal branch of gov't, yet it is able to act as if it is above all others. Either make it fair and equal or get rid of it.

 

But the question is, how? What is the constitutional mechanism through which the Dems can expand the court? Is it through a bill that is passed?

 

Yes, if Dems expand the court than the GOP will do the same the moment they can... but if Dems expand the court and then organize a bunch of high-importance cases to get sent to SCOTUS the way the GOP has been doing, we can get rulings that protect minorities, reinstate things that have been swatted down, and a slew of other protections that are needed.
