Judge Strikes Down Arkansas Law Banning Gender Transition Care for Minors

In his 80-page ruling, Judge James M. Moody Jr. of Federal District Court in Little Rock said the law both discriminated against transgender people and violated constitutional rights for doctors. He also said that the state of Arkansas had failed to substantially prove a number of its claims, including that the care was experimental or carelessly prescribed to teenagers.

“Rather than protecting children or safeguarding medical ethics, the evidence showed that the prohibited medical care improves the mental health and well-being of patients and that by prohibiting it, the state undermined the interests it claims to be advancing,” Judge Moody wrote.

So this will end up at SCOTUS after appeals, at which point it'll be upheld.

 

Unless I'm missing something, as I'm not a lawyer.

There's no legal reason to oppose gender affirming care, you have to break the constitution to do it. Funny enough, republicans are anticonstitution experts.

No, it will not be upheld, if the SCOTUS even hears it.

There is no constitutional basis for banning health care, and there is even less basis for taking that choice away from parents.

 

And Republicans know this. All of these bills being passed are nothing but virtue signaling to keep their base angry because Republicans refuse to do anything to actually help people.

Many people, including many liberal parents, actually see surgeries and chemical castration as mutilation and abuse. Just because "experts" say this is not true doesn't really make it so. Remember, the very basis of this gender identity movement/ gender affirming care was from the fraudulent studies by Dr. John Money. The kid who he experimented it on eventually committed suicide as an adult.

 

There are no long-term studies to indicate that gender affirming surgeries and medications that start in childhood result in better long-term outcomes. Adults should have the freedom to do whatever they want with their bodies, but leave children alone.
