Yes, but only for the post-2020 stage of this litigation. Kesha wanted to have the full damages and fees for the entire litigation since 2014, while Luke argued that Kesha should not be entitled to anything at all. In the end, the majority of the court decided that the breaking point should be the effective date of the statute (November 2020). 1
