Eh, I am not surprised they did not hold him. Who actually thought they would do that? And I agree, I do not think he is a flight risk considering he is followed by Secret Service all day, every day. Let him stay out and continue incriminating himself. :ahh:

Legal Analysts Say Jack Smith Signaled More Serious ‘Leaking’ Charges For Trump in New Jersey

Former president Donald Trump pleaded “not guilty” to the 37 federal counts against him yesterday, but legal experts claim that the text of the indictment issued by special counsel Jack Smith could leave Trump open to additional charges.

 

While it’s only speculation, Ryan Goodman and Andrew Weissmann write in The Atlantic that none of the 37 counts outlined in the 49-page indictment include a charge of dissemination of classified information, a “steeper” charge. The reason for this, they suspect, is because these charges were made in Florida — but the possible dissemination, or communication of information or materials may have happened in New Jersey:

According to the Justice Department and a taped recording of the former president, Trump took classified records from Mar-a-Lago to Bedminster, where he showed off the contents of such records to others. The indictment alleges that Trump showed a map to a political ally and also showed a writer and a publisher a secret military plan to attack Iran. These two episodes were arguably the most egregious allegations of criminal wrongdoing mentioned in the indictment; they allege not just the improper retention of our nation’s most highly classified information, but the intentional communication of such information.

The recording they mention is the one obtained by CNN in which Trump is heard “waving around documents” and saying, on tape, “Secret. This is secret information. Look, look at this” and “This was done by the military and given to me.” Goodman and Weissmann point out that while illegal retention of classified information is a serious charge, the “deliberate dissemination” is much more serious. It would mean that Trump allegedly, deliberately leaked classified information while at his Bedminster club in New Jersey, a separate charge.

 

The article cites a few reasons for this, one of them being the likelihood of prosecution in the chosen venue of Florida. With Trump-appointed Aileen Cannon as the judge on this case, there are concerns that she may not be objective when it comes to the former president. There is also the chance that Cannon could “pocket-veto” the charges by scheduling the trial for a date after the 2024 election, giving Smith the chance to bring up new charges in New Jersey ahead of that date.

 

The lack of dissemination charges in the indictment is curious if Trump did (allegedly) talk about the classified information he received to others. According to Smith’s carefully-worded indictment, Trump allegedly transported boxes of documents from Florida to New Jersey. But that possible act of dissemination is something that happened while Trump was in New Jersey, leaving him open for another, more serious charge. Maybe. X

I live in London, during the pandemic I was shocked by Trump and its supidity and so I became addicted to American politics, I watch it on a daily basis and many times I prefer it to Netflix if I’m alone (Drag Race always has priority 😀)

 

I think I watched it in the hope that ‘thr good forces’ will eventually win but American politicians are so f’ed up that I refuse to give one more minute to those horrible Republicans ( Jordan, McCarthy, Greene, Graham, DeSantis and .. I can’t even spell her name Bo… Boe…. Ewwwww!)

Trump Reportedly Kept Government Documents Because a Non-Lawyer Told Him He Was Allowed To

 

Donald Trump took the advice of a person with no formal legal training who told the former president he was allowed to retain government documents, according to the Washington Post.

 

On Wednesday, the Post relayed a mind-boggling story about how Trump passed up multiple opportunities that could have avoided the current legal peril in which he finds himself. Trump was arraigned on Tuesday in a Miami federal courtroom on 37 counts stemming from his handling of government documents after he left office. The Department of Justice alleges he willfully took classified documents to his Mar-a-Lago residence and obstructed the government’s efforts to recover them. He has pleaded not guilty to all counts.

 

According to Post’s report, in the fall of last year, Trump attorney Christopher Kise “wanted to quietly approach Justice to see if he could negotiate a settlement that would preclude charges, hoping Attorney General Merrick Garland and the department would want an exit ramp to avoid prosecuting a former president.”

 

Trump rejected the idea, instead choosing to listen to lawyers and other advisers who urged him to take a more combative approach toward the DOJ. The report further said Trump repeatedly rejected otherwise sound advice from his attorneys while seeking the counsel of Tom Fitton, the head of Judicial Watch, a right-wing activist organization. Despite the name of his group, Fitton has no formal legal background whatsoever. The Post reported:

 

Trump time and again rejected the advice from lawyers and advisers who urged him to cooperate and instead took the advice of Tom Fitton, the head of the conservative group Judicial Watch, and a range of others who told him he could legally keep the documents and should fight the Justice Department, advisers said. Trump would often cite Fitton to others, and Fitton told some of Trump’s lawyers that Trump could keep the documents, even as they disagreed, the advisers said.

 

The publication caught up with Fitton who declined to discuss the details of his advice to Trump, but had words for his legal team.

 

“I think what is lacking is the lawyers saying, ‘I took this to be obstruction,’” Fitton said. “Where is the conspiracy? I don’t understand any of it. I think this is a trap. They had no business asking for the records… and they’ve manufactured an obstruction charge out of that. There are core constitutional issues that the indictment avoids, and the obstruction charge seems weak to me.”

 

The Post stated that several Trump advisers blame Fitton for giving the former president bad advice.

 

Even conservative legal minds say Trump had no business retaining documents generated by the government. Jonathan Turley called the indictment and the evidence in it “damaging,” while former Trump Attorney General Bill Barr said the ex-president is “toast” if even just half of the government’s allegations are true.

NY Attorney General Letitia James Says Manhattan Case Against Trump ‘Will Unfortunately Have to Be Adjourned’ Pending Federal Case

 

Letitia James explained that her case and others currently pending against Donald Trump “will unfortunately have to be adjourned” while the ex-president faces federal indictment for his unlawful handling of classified documents.

 

The New York attorney general made the comments while speaking with with MSNBC’s Alex Wagner on a panel at the Tribeca Film Festival. Wagner asked if Trump’s documents trial will “intersect” with James’ investigation into the alleged financial fraud of Trump’s family and his business empire. James answered that the timing would impact not only her case, but also the Stormy Daniels hush money case from Manhattan DA Alvin Bragg, and even the case Trump potentially faces for his effort to overturn Georgia’s 2020 election results.

 

“In all likelihood, I believe that my case as well as DA Bragg and the Georgia case, will unfortunately have to be adjourned pending the outcome of the federal case,” James said. “So it all depends upon the scheduling of this particular case. I know there’s gonna be a flood, a flurry of motions, motion to dismiss, discovery issues, all of that. So it really all depends. Obviously, all of us want to know what Judge [Aileen] Cannon is going to do and whether or not she’s going to delay this particular case.”

 

Trump has raged against James’ investigation on numerous occasions, though the bulk of his focus of late has been redirected toward the 37 criminal counts he faces for obstruction and conspiracy in connection with his mishandling of documents. X

Mike Pence declined to pledge to pardon Donald Trump during an interview with conservative radio host Clay Travis on Wednesday.

 

Pence, who served as vice president in the Trump administration and is running for president in 2024, faced a grilling on the former president’s federal criminal indictment during an appearance on the The Clay Travis and Buck Sexton Show.

 

Trump faces a 37-count indictment related to his handling of classified documents. He pleaded not guilty in federal court this week on allegations he defied a subpoena and obstructed justice in an effort to retain highly classified documents — including nuclear secrets, U.S. defense capabilities, and potential vulnerabilities of the U.S. to foreign attack. He faces hundreds of years in prison.

 

The former president has faced a wave of condemnation over the allegations contained in the indictment, including from conservative legal analysts. His own attorney general, Bill Barr, said Trump is “toast” if “even half” of the allegations in the indictment are true.

 

Pence, who Trump supporters sought to hang on Jan. 6 over his refusal to attempt to overturn the 2020 election, has also condemned Trump’s alleged conduct. In his interview with Travis, the commentator and Outkick founder asked whether he would pledge to pardon Trump if he is indeed convicted of these charges.

 

“Well, first off, these are serious charges,” Pence replied. “And as I said, I can’t defend what’s been alleged, but the president does deserve to make his defense. And I would say to each one of you, look, I’ve been a former governor. I’ve actually granted pardons to people and I take the pardon authority very seriously. It’s an enormously important power of someone in an executive position. And I just think it’s premature to have any conversation about that right now.”

 

Travis argued that “as a matter of principle,” given his belief Trump “is being prosecuted for political-based reasons,” presidential candidates should pledge to pardon Trump even before the prosecution goes forward.

 

Travis conceded the allegations against Trump “are serious” but “allowing Donald Trump to be put in prison” is a worse result than “taking a principled stand in saying, as a matter of principle, this shouldn’t happen.”

“With all due respect, when you aren’t telling us what your decision would be, I think you’re dodging the question and frankly, not stepping up on the front of leadership,” Travis said.

 

“I don’t think you know what the president’s defense is, do you?” Pence shot back. “I mean, what are the facts? I mean, look, we either believe in our judicial process in this country or we don’t. We either stand by the rule of law or we don’t.”

 

“What I’m hearing is you’re fine with Donald Trump being put in prison, sir,” Travis replied. “And that to me, since you were his vice president feels pretty disrespectful.”

 

Pence has spoken out against Trump since the former president egged on the rioters who stormed the U.S. Capitol on Jan. 6, beating cops and chanting “Hang Mike Pence!” Earlier this month, he launched a presidential campaign to challenge his former running mate, and has ramped up his criticism of Trump’s behavior. X

 

“It’s premature,” Pence told Travis. “Let’s let the process play out. Let’s follow the facts. And I promise you, as president of the United States I’ll do just that.”

Mar-A-Lago Sought 380 Foreign Workers During Time Trump Had Access To Classified Documents

 

 

Mar-a-Lago looked to employ 380 short-term foreign workers from 2017 to 2022, when Trump had access to classified documents, initially as president and ultimately as a former official living at the club.

 

According to the indictment, Trump stored classified documents in the ballroom, a bathroom, his bedroom, a storage room and his office. It’s unclear who exactly could get inside those areas, but it would stand to reason that some Mar-a-Lago staff could access them.

 

Last winter, Mar-a-Lago sought out 91 foreign workers, according to records filed with the Department of Labor. While Trump’s White House tried to prevent employers from relying on foreign workers, it targeted permanent employees—not the temporary ones Mar-a-Lago and other Trump properties hire. [...] X

DOJ Seeks To Block Trump From Sharing Classified Docs

 

 

The Justice Department on Friday filed a motion seeking to block former President Trump from releasing any classified materials that will be released to his legal team during his prosecution for the mishandling of records at Mar-a-Lago.

 

The suggested protective order, which will be reviewed by Judge Bruce Reinhart, would allow Trump to review the 31 documents the DOJ is using in the case only while in the presence of his attorneys.

 

“Defendants shall only have access to Discovery Materials under the direct supervision of Defense Counsel or a member of Defense Counsel’s staff. Defendants shall not retain copies of Discovery Material. Defendants may take notes regarding Discovery Materials, but such notes shall be stored securely by Defense Counsel,” the DOJ wrote in a suggested protective order. X
