The conflict arose from the accuser trespassing and destroying private property, not because he bought a house. The physical altercation is not where the hate crime charges derives from either. The judge is arguing that the usage of "haole" denotes anti-white hatred. It'd be like arguing the usage of "gringo" in a fight constitutes anti-white hatred. There's an issue with hypocrisy with the assault charges (one has to just think of George Zimmerman being granted the right to stand his ground), but an assault charge would be reasonable. To suggest that there is grounds to file anti-white hate crime charges is the issue with the case.

I don’t know about the “hate crime” aspect of it all, but their sentences are way too low for a violent crime like this. One of them is even a repeated offender. Lock them up! Props to the victim for not using the lethal force he’s entitled to. Violence doesn’t solve violence.

I found no mention of what state charges might have been brought against them. It does leave me wondering if there might have been a reluctance on the part of local prosecutors to bring charges against the native Hawaiians. The hate crime charges might have been the only way federal prosecutors could insure that something would be done in response to the attack
