They would have to copyright the phrase to prevent him from using it, but with a generic phrase like that, the best they can do is trademark. Espresso Posted November 3, 2022 Share Posted November 3, 2022 These men have not become “the legal owners of the phrase’s trademark for its use on clothing.” Their application is pending and was filed with an “intent to use” basis, meaning they have not yet shown use of the mark, which will eventually be required if they want a registered mark. The article also says the original owner of the mark assigned his rights to these men, but wants to remain anonymous. The assignment is public and I can see his name right now. But more importantly, he only assigned the application, not an officially registered mark. Really sloppy reporting by multiple outlets.
