they are actually right!

vote in your state to elect the right people, so if the SC overturns an importing issue, then the state will keep it legal like the state California and NY,

but I'm not American and I don't have enough info about the US, but that's what I know.

What is the point? Voting for Dems who will pass bills for Biden to sign is the point. A law that is passed is much, much harder to strike down via SCOTUS than a regulation or previous precedent.

 

But you're right overall. It's scary to think that any progression we make can be struck down by a radical right-wing SCOTUS.

Sadly it seems the court was already much more conservative than many members wanted to let on even before 2016 given that a pre-Trump SCOTUS is who halted the Clean Power Plan despite being part of thr majority who previously decided in favor of the EPA years and years beforehand. 

 

 

If Democrats want people to vote, they need to illustrate a clear plan on how we overcome this. Talk in specific details about proposals to reform the judicial branch and end its overreach.

The Supreme Court interprets the law and their interpretation oversees that of the country as its highest court. 

 

They had found in the various cases brought before them that states attempting to do things like make gay marriage illegal or make abortion before the end of the second trimester illegal were unconstitutional. Thus it became that states could no longer do these things as the reversal was now de-facto the law of the land. IE: it's unconstitutional to ban gay marriage, thus no states could legally ban it and gay marriage is de-facto legal. 

 

For abortion, it was a death by a thousand cuts, where red states instead pushed more and more restrictions to access like laws that a doctor must make a woman hear the fetus' heartbeat before she is allowed to decide, extended wait periods from request.for the procedure versus when it could be done, etc. And then when one of these restrictions would be unchallenged or allowed to stand cause it was passed back down by the court, more and more red states would copy it and pick it up. 

 

Most of these lawsuits or laws were funded by elite organizations funded by the Christian elite with the intent to trigger a case that could be brought forward to the SCOTUS and allow them to make the decision they did. Basically not that abortion is illegal but that its decision that banning abortion in the way they previously deemed as unconstitutional was outside of the jurisdiction of the court and an overreach of its powers, with many of the conservative judges arguing yhst the SCOTUS asserted that there exist a fundamental right within the constitution that does not actually exist on the basis that abortion does not exist within the "historical tradition of America".

FYI regulating carbon emissions is only a tiny percentage of what the EPA actually does, but yes this would be bad.
