I am far from an expert on Spanish tax law but this feels like harassment at this point. this seems like a disagreement in how the law is interpreted regarding the question of “residency”. At least in the US you can normally challenge this without the government threatening to send you to jail. If you fail to win your case, then you pay the tax and move on with life. It's not harassment, it's because the Spanish gave her chances to admit she is a tax resident in Spain, but she keeps on denying it. So the Spanish tax office even hired investigators to follow her everywhere, even to her dentist, her hairdresser, watching her drop her kids to school. She was under constant surveillance and they collected enough evidence to show she was living in Spain for at least 183 days (which is the trigger for tax residency) in the time period they are prosecuting her for. If Shakira just admitted and tried to agree a settlement from the beginning, this could have been over. But I feel like she's not being advised so well. Sure she could still win her case (although now Spain has a lot of evidence on her) but going to a trial is very messy and a PR nightmare, so good luck Shaki. Edited May 26, 2022 by Zack
schnetzka Posted May 26, 2022 Posted May 26, 2022 I feel like this has been going on for a long time. But also, everybody keeps throwing around the possibility of jail and all of that but realistically what will happen? I know everyone likes to joke but I'm generally curious.

Gui Blackout Posted May 26, 2022 Posted May 26, 2022 They need to leave her alone. She has made so many great contributions to society, a little mishap should be pardoned.

Spain and Colombia have a tax treaty though and Article 4 of that treaty settles residency disputes. If she was a resident of both states at the time, the tiebreaker would likely come down to nationality which was Colombia at the time right? Either way, this is a legitimate question of legal interpretation and you should be allowed to challenge/resolve that without that state threatening your liberty.

She's not saying that she was resident in Colombia either. She's saying she was resident the whole time in The Bahamas. But when the Spanish tax office investigated, they couldn't find evidence that she lived even one day there.
GeeDuval Posted May 26, 2022 Posted May 26, 2022 Does this mean new music coming or major performance/appearance? I feel this headline comes out right before a major announcement. Anyway, Spain is just butt hurt they were challenged by her lawyers and at this point it has turned into harassment. had she lived in Miami she could of avoided all this BS. Spain is doing too much, don’t know why celebs from other countries even bother living there.

Interesting facts, she needs a new PR team, it looks really bad that she thinks she is above the law
Khal Posted May 26, 2022 Posted May 26, 2022 I feel like this is going to end in a hefty fine and suspended sentence. Not like she's in danger of actual prison

UnusualBoy Posted May 26, 2022 Posted May 26, 2022 It's as simple as paying the taxes and call it a day, rich people are so stingy.

She owns an island in the Bahamas and one of her neighbors there is a member of Pink Floyd. She did use to live there. But her PR team sucks for letting her drag this on for years. She already paid the taxes. She could easily make back all the money by working, touring, and releasing new projects. I'm not sure why she continues to fight it.
