A scenario where both aren't successful in their libel action is very likely.

 

To be fair, I don't think Amber's team have done a good job proving her counterclaim to a reasonable standard. How much money Waldmann's statements and leaked tapes caused her financially was very difficult to assess without some studio execs testifying something like: "Oh, yeah we would have hired for this film for X millions if it wasn't for what Waldmann said."

 

And Depp's team has done a terrible job at proving that Amber's statement was false, that there was actual malice involved and that it caused actual damage to his career (something he had already done to himself prior to her op-ed). The weakest part of this case is probably the actual damages he claims to have suffered. There are multiple testimonies that point towards her career slowing down and his latest movies underperforming, issues on set and substance abuse issues being studios' main concern, rather than Amber's claims. Remember that Disney exec said they paid attention to the 2018 RS magazine when they decided not to greenlight another Pirates movie, that magazine came out months before the op-ed and mostly focused on his substance abuse issues.

 

I just don't see a scenario where Depp wins and is awarded money. And there's a very tiny chance Amber wins her counterclaim and it's awarded way less than her 100M because she wasn't able to prove Waldmann's statements caused her to lose that amount (100M is impossible IMO).

The ex-TMZ employee testimony coupled with that embarrassing Heard deposition slip up from 2016 must have been quite hard to watch for Amber's team. Doesn't look good. Then again neither do the accounts of Depp's alleged abuse. Hard to know what the outcome of this trial will be considering both of them are obviously gutter trash humans, it's entertaining af though.
