Does this mean mixtapes (not released on any service that you can profit from, like SoundCloud, or for free download) are effectively illegal now?

Unless the DJ paid Nicki royalties for playing it, how could Tracy sue over this? Mixtape songs with uncleared samples have been played before all the time with no issue

It clearly says she settled and made the offer to Chapman. She didn’t “lose” the case. She most likely respects her enough not to drag her through the courts - which would be a PR disaster. She also did nothing wrong, the were no profits made from the leaked song.

They have always been illegal if they use unauthorized samples.

Why waste more court costs for the inevitable loss?

 

that said, she did so something wrong and a profit doesn't determine the validity of a lawsuit based on actions.

drake once pushed back his entire album beyond his birthday because he had to wait for clearance. If the artist wants to sue they have grounds to.
