Mexican pop star Paulina Rubio has lost a major battle in her long-running custody fight with her ex-husband, Nicolás Vallejo Nájera, better known as "Colate," over their son, Andrea Nicolás. A judge in Miami, where the former couple has been locked in a years-long court war over the now 14-year-old boy, ruled against the singer this week.

 

Rubio and Colate's legal battles stretch back longer than their actual marriage, which lasted five years. The first court filings date back to 2012, and the case has been dragging on ever since, shifting from divorce proceedings to a heated custody fight over Andrea Nicolás.

 

The latest dispute began a few months ago, when Nico refused to return to his mother's home after a visit with Colate. In a surprising twist, the teen spoke directly to the judge, claiming he was being mistreated.

 

Rubio's attorneys argued that Colate had effectively abducted the child, but the judge wasn't convinced. Instead, she ruled this week that Nico could spend the remainder of his summer break in Spain with his father.

 

However, the judge imposed a strict condition: Paulina Rubio must personally take her son to Spain and pick him up herself at the end of the trip, eliminating any accusations of parental abduction.

 

It's unclear whether Rubio has already traveled to Spain to drop off Nico. What is known is that Miami schools resume classes in mid-August, meaning the boy will likely spend about a month overseas before returning.

 

The bigger question now is what happens when summer ends. The judge still needs to issue a final ruling on the boy's primary residence, whether he will live with his father or his mother. Nico has reportedly expressed a preference to stay with Colate, but Rubio claims her ex has been manipulating their son.

 

Andrea Nicolás is Rubio's oldest child. La Chica Dorada also shares a younger son, Eros, with Mexican singer Gerardo Bazúa. Both Colate and Bazúa live in Miami, close to Rubio's main residence, so they can remain near their children.

Ugh. Didn't follow the case through the years but I thought Paulina had a bit of an "advantage" and the kid preferred to stay with her. Sad.

Regardless of whether she and the father have beef, if she did indeed beat her son then I don't feel bad for her. A nonpartisan party was the one that called the police because they could hear him screaming. She doesn't deserve to be let off the hook for that just because the dad is money hungry. What kid would want to be with a parent that beats on them?

The kid has been wanting to leave her and stay with his dad for years? Where do you get this information from lol

From ignorance lol. Like I said I haven't followed this closely, I don't even remember from where I gathered that. I thought maybe things changed recently for the worse.

He seems like a happy closure for the kid, no? 

 

For a kid to go to a judge and plead to not be with his own mother at 14 years old is very rare.
